The Buyer commits to settling the remaining balance of the total amount through a certified check or money order upon receipt of the goods and confirms receiving a completed version of this purchase order. All deliveries outside the continental U.S. require full payment before shipment, as COD is not an option. This quote does not cover sales tax, import duties, brokerage fees, installation, or anchor bolts. Under no conditions should the driver be given cash for any outstanding balance on the building. The Buyer’s purchase order will only become legally binding once it has been approved in writing by an authorized representative of the Seller. The Project Manager responsible for preparing this order is not an officer of the Seller and cannot accept the order on the Seller’s behalf. If the order is accepted, a signed “Acceptance” copy will be sent back to the Buyer; otherwise, the initial payment will be refunded. Once the order is accepted, the Buyer forfeits the right to claim any refund on the initial payment made to the Seller's Project Manager. In the event of a delay not caused by Surmix Steel, any increases in the price of steel, materials, or shipping after the requested delivery date will be passed on to the Buyer. The Buyer will be notified of such changes via a Change Order, which will outline the revised pricing. The Buyer must either approve the change by signing the Change Order or cancel the contract, though they will still be responsible for any work completed and materials ordered up until the cancellation date. Any items not explicitly listed in this proposal, such as foundation design or anchor bolts, are not included in the quoted pricing.

Warranty Details

14 & 12 GAUGE – A 20-year warranty is provided against rust perforation.

Environmental Exclusions

This limited warranty does not cover the following conditions:

Exposure to chemical agents, fumes, liquids, or solids other than rainfall coming into contact with the product.

Contact with soil, ashes, fertilizers, or other moisture-retaining substances.

Failure to clear debris or ensure proper water drainage, including internal condensation, on all product surfaces.

Damage caused by exposure to green, wet wood, or treated pine.

Installations exposed to highly corrosive environments at any point in the future.

Natural disasters such as storms, tempests, or other acts of nature.

Maintenance Requirements – The surface of the paint must be cleaned annually with mild soap and neutral, clean water. Abrasive materials or chemical cleaners must not be used on the paint surface.

Any modifications or changes made to the structure post-installation will void U.S. Structural Steel’s responsibility for the unit, including its warranty and certification. The building comes with anchor bolts for concrete installation..

CONCRETE DESIGN DISCLOUSURE

The slab and foundation design provided is intended solely for structural use. It does not account for factors such as concrete strength for durability, moisture or vapor barriers, subbase material specifications, installation procedures, or thermal insulation needs. It is recommended to consult a qualified expert for advice on any aspects not covered in this design.


 

Terms And Conditions

1. Contract Activation
This Purchase Order, including these Terms and Conditions, becomes a binding contract upon written acceptance by an authorized representative of the Seller. Once accepted, neither party can cancel the contract.

2. Payment Terms
Payment timing and conditions are critical. The charges for the goods and services, as outlined in the Purchase Order or any written change order, must be adhered to. For custom-manufactured goods, prepayment may be required in part or full. The Seller reserves the right to demand advance payment for delivery or manufacturing. If the Buyer’s creditworthiness becomes questionable, the Seller may require payment in advance before proceeding.

3. Specifications for Purchased Goods
a. The Seller may provide drawings at the Buyer’s request, including anchor bolt plans and cross-sections, for approval. A duplicate set will be sent for Buyer approval, and any requested changes or approvals must be submitted within 30 days. After receiving the approved drawings, Seller will proceed with detailed shop drawings and production.
b. Any requested modifications must be agreed upon through a written Change Order, signed by both parties, outlining the changes and cost adjustments.
c. Dimensions provided are approximate. Exterior measurements are standard, and final dimensions may vary due to factors like the concrete base.
d. The Buyer is responsible for ensuring soil and subsoil conditions are adequate for the foundation, building, and stored materials.
e. The Seller holds no responsibility for the assembly of the building, and the Buyer releases the Seller from any claims related to the construction process.
f. The Buyer and building erector must follow all specifications provided by the Seller. Any deviations from these instructions will result in the Buyer indemnifying the Seller from related damages or costs.

4. Delivery Terms
Unless otherwise specified, the Purchased Goods will be shipped FOB (Free on Board) to the Buyer’s designated location, transferring the title and risk of loss to the Buyer upon delivery. If the Buyer causes any delay, the Buyer will bear the cost and risks associated with storing the goods and will be responsible for paying the contract price in full, along with additional storage and shipping costs.
a. Delivery dates are estimates and depend on receiving all required information from the Buyer. The Seller is not responsible for any indirect or special damages resulting from delivery delays caused by factors outside the Seller’s control, including natural disasters, labor disputes, or material shortages.
b. The Buyer must accept delivery within 14 days of notification. Failure to accept delivery on time may result in the Seller storing the goods at the Buyer’s expense or treating the contract as breached, with associated costs and penalties.

5. Dispute Resolution
Any disputes related to the quality or condition of the goods must not affect the Buyer’s obligation to accept and pay for the goods. The Buyer must accept delivery and make claims under the Seller’s warranty.

6. Claims for Shortages and Defects
Goods are considered fully accepted unless any shipping damages are reported on the bill of lading at the time of delivery. Claims for shortages must be made in writing within 30 days of delivery. The Buyer’s remedy for defects or shortages is limited to the repair or replacement of defective parts, as determined by the Seller. The Seller is not liable for any incidental or consequential damages.

7. Liquidated Damages
If the Buyer breaches the contract, the Seller is entitled to liquidated damages. These damages include:
a. 60% of the purchase price for breaches before shipment.
b. 60% of the purchase price plus shipping and storage costs for breaches after shipment.
c. 100% of the purchase price for breaches after delivery.
d. 100% of the purchase price for custom goods, with additional shipping and storage costs after shipment. The Buyer agrees that these amounts are reasonable estimates of the Seller's potential losses.

8. Security Deposits
In the event of a breach, the Seller may retain any security deposit paid by the Buyer, in addition to pursuing other remedies under the contract.

9. Security Interest
The Buyer grants the Seller a security interest in the building or structure purchased to secure payment. If the Buyer defaults, the Seller may demand immediate payment of all obligations and pursue the remedies of a secured party.

10. Indemnity
The Buyer agrees to indemnify and hold the Seller harmless from all losses, claims, or expenses arising from any act or omission of the Buyer or third parties related to the building.

11. Warranty
The Seller provides a one-year warranty from the date of shipment for defects in materials and workmanship. The warranty does not cover damage caused by natural disasters, accidents, corrosive environments, or failure to maintain the building. The Buyer must maintain the building to avoid issues like snow accumulation. The Seller disclaims all other warranties, including implied warranties of merchantability or fitness for a particular purpose.

12. Compliance with Laws
The Buyer is responsible for ensuring compliance with all applicable laws, building codes, and zoning regulations. The Seller is not liable for damages caused by the Buyer’s failure to comply.

13. Taxes and Duties
The Buyer is responsible for any sales taxes, duties, or other government fees related to the purchased goods. If the Seller pays any such amounts on behalf of the Buyer, the Buyer must promptly reimburse the Seller.

14. Entire Agreement
This contract represents the entire agreement between the parties and supersedes any previous representations or agreements. Any changes to this contract must be made in writing and signed by an authorized representative of the Seller.

15. Governing Law and Venue
This contract is governed by the laws of the State of Georgia. The Buyer agrees to the jurisdiction of courts in Atlanta, Georgia, for any legal proceedings related to this contract. If any part of this contract is deemed invalid by a court, the remaining provisions will continue to be enforceable.

Policy Guidelines
 

Surmix Steel Inc. ensures competitive pricing on our inventory. This Low-Price Guarantee applies to most items listed in our online store's current active stock. It cannot be combined with other discounts or coupons. To qualify for the Low-Price Guarantee, you must provide a competitor's current advertisement, estimate, or invoice. We will beat any local competitor's advertised price or regular price on comparable items by 5%.


Price Match Policy
 

  • Customers must notify Surmix Steel Buildings of the competitor’s price and retailer (local or online).
  • We reserve the right to verify the competitor's price and availability of the same product (including size, model, quantity, brand, and color).
  • The product must be in stock on the competitor’s website at the time of the Price Match request.
  • We reserve the right to limit purchases to one item per customer, per day.
  • Price matches are subject to Surmix Steel's discretion.
  • Price matches do not apply to items sold in China or other Asian markets.
